Paul McCartney and Heather Mills set for court battlePaul McCartney and Heather Mills are set to take their divorce to the open court next February, having failed to reach a private settlement.
Despite rumours that the two would reach a settlement of ?60 million, a source said that the five day hearing has been scheduled with a fall back date later in 2008 if the February hearing fails to produce an agreement.
The stumbling block is believed to be Mills' refusal to accept a gagging order as part of the deal.
Her spokesman declined to comment and no one was immediately available to comment from the McCartney camp, reports Reuters. White Stripes unveil Icky cover art

The White Stripes unveiled the release date and cover art for their new album Icky Thump today.
Jack and Meg White's sixth album will hit stores June 19 on Warner Bros. Records in the US and one day earlier on XL Recordings in Europe. The Icky Thump cover art is a black-and-white photo of Jack and Meg sporting bedazzled outfits and sitting on a log.
The album, the duo's follow-up to 2005's Get Behind Me Satan, is said to include bagpipes and trumpet work from a previously unknown Latin musician. The record will feature 13 songs and marks the duo's first album since Jack White recorded and toured with his side project, the Raconteurs.
Jack White produced the new album, which was recorded over a three-week period at Nashville's Blackbird Studio.
Other than a performance at the Bonnaroo Festival in Tennessee June 17, the band has yet to announce any North American tour dates. A European tour is set to kick off June 1.
